Terms of Service

Welcome to Lumina ("Lumina," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of the Lumina website, dashboard, Discord bot, and related services (together, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Description of Service

Lumina provides a staff application management platform for Discord communities. Server owners and administrators ("Server Managers") can create, distribute, and review staff applications, and community members ("Applicants") can submit applications through the Service. Some features are free and some are paid (see Section 6).

2. Eligibility and Accounts

• You must be at least 13 years old, or the minimum age required to use Discord in your country, whichever is higher.
• You must comply with Discord's Terms of Service and Community Guidelines. Lumina is not affiliated with or endorsed by Discord Inc.
• You sign in using your Discord account. You are responsible for keeping your account secure and for all activity that occurs under it. Notify us promptly if you believe your account has been compromised.

3. Roles and Responsibilities

Server Managers are solely responsible for:

• The content of their application forms and the questions they ask.
• How they review, store, and use Applicants' responses, and for any staffing decisions they make.
• Ensuring Applicants are told how their responses will be used, and complying with any laws that apply to them.
• Configuring the bot and its permissions in their server.

Applicants are responsible for ensuring the information they submit is truthful and that they have the right to share it.

Lumina provides tools only. We are not a party to the relationship between Server Managers and Applicants, and we do not make or influence staffing decisions.

4. User Content

• "User Content" means anything you submit through the Service, including application forms, application responses, comments, and review notes.
• You keep ownership of your User Content.
• You grant Lumina a limited, non-exclusive, worldwide license to store, process, and display your User Content solely as needed to operate and improve the Service and to provide it to the Server Managers and users you choose to share it with.
• You are responsible for your User Content and represent that you have the right to submit it.

5. Acceptable Use

You agree not to:

• Use the Service for any illegal, harmful, or unauthorized purpose.
• Submit content that is unlawful, harassing, hateful, sexually explicit involving minors, or that infringes anyone's rights.
• Use application forms to collect sensitive information (such as passwords, government IDs, or financial account details) or to collect data unlawfully.
• Attempt to gain unauthorized access to the Service, other accounts, or our systems, or interfere with the Service's operation (including through scraping, automated abuse, or excessive requests).
• Reverse engineer, copy, or resell the Service, except as permitted by law.
• Impersonate another person or misrepresent your affiliation with any person or server.
• Use the Service in violation of Discord's terms or policies.

6. Paid Features and Billing

• Certain features of the Service require payment ("Paid Features"). Prices, billing intervals, and what each plan includes are shown at the time of purchase.
• Payments are processed by a third-party payment processor. We do not store your full payment card details.
• Unless stated otherwise at checkout, paid plans are billed in advance and renew automatically at the end of each billing period until you cancel. You can cancel at any time, and your Paid Features will remain available until the end of the period you have already paid for.
• You are responsible for any applicable taxes.
• Founder's Edition is a one-time purchase that provides access to Paid Features for the lifetime of the Service, meaning for as long as Lumina operates the Service. It does not renew.
• Refunds, if any, are governed by our Refund Policy.
• We may change prices or plans. For existing subscribers, price changes take effect at the next renewal after we give you notice.
• If a payment fails or is reversed, we may suspend or downgrade access to Paid Features until the balance is resolved.
• Paid Features are tied to the account that purchased them and may not be transferred or resold.

7. AI Support Assistant

The Service includes an AI-powered support assistant ("Lumina Guide"). Its answers are generated by third-party AI models and may be incomplete or inaccurate, so please verify anything important. Do not submit passwords, API keys, payment information, private application answers, or other sensitive information to it. How these conversations are handled is described in our Privacy Policy.

8. Privacy and Cookies

Your use of the Service is also governed by our Privacy Policy and Cookie Policy, which explain what data we collect and how we use it.

9. Intellectual Property

The Service, including its software, design, branding, and content we create, is owned by Lumina and protected by applicable intellectual property laws. Except for the limited right to use the Service under these Terms, we grant you no rights in it. "Lumina" and related logos are our marks; you may not use them without permission.

10. Third-Party Services

The Service relies on third-party platforms, including Discord, our payment processor, and AI model providers. We are not responsible for third-party services, and your use of them is subject to their own terms. Outages, changes, or restrictions on those platforms may affect the Service.

11. Availability and Changes to the Service

We aim to keep the Service reliable, but we do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue any part of the Service at any time, with or without notice.

12. Termination

You may stop using the Service at any time and may request deletion of your data as described in our Privacy Policy.

We may suspend or terminate your access at any time, with or without notice, including if we believe you have violated these Terms, created risk or legal exposure for us or other users, or if we discontinue the Service. If we terminate your account, any refund is handled under our Refund Policy. Sections that by their nature should survive termination (including Sections 4, 6, 9, 13, 14, and 15) will survive.

13. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE SECURE, ACCURATE, OR AVAILABLE AT ANY PARTICULAR TIME.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LUMINA AND ITS OWNERS AND CONTRIBUTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR $100 IF YOU HAVE NOT PAID US ANYTHING.

Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

15. Governing Law

These Terms are governed by the laws of the State of Ohio, United States, without regard to conflict-of-law rules. Any dispute arising from these Terms or the Service will be resolved in the state or federal courts located in [COUNTY] County, Ohio, and you consent to their jurisdiction, unless applicable law requires otherwise.

16. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date above and may notify you through the Service or our Discord server. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
